Introduction:

Welcome to Zoom Bar LLC, doing business under the name "Zoom Bar." We are Nashville's premier mobile bartending service, dedicated to delivering exceptional cocktail experiences for your events. These terms and conditions ("Terms") govern your use of Zoom Bar LLC's services. By booking with us, you agree to these Terms and our operating agreement.


Booking and Services:

(a) Booking Process: Our streamlined booking process requires no consultation. Simply select your package, event date and duration. A confirmation email will be sent upon successful booking. (b) Mobile Bartending Services: Zoom Bar LLC provides professional bartenders and a mobile setup for your event, offering options for crafted cocktails and mixers. Guests must provide their own alcohol.


Pricing and Cancellation:

(a) Pricing:

Our pricing is strictly based on the package and duration of the event and not on the size of the event. Only one Zoom Bar LLC server is required to be present for an event, regardless of the event's size. It is listed on our website that we recommend multiple servers for parties of 50 or more. An “add-on" is available for purchase to include an additional bartender.


(b) Cancellation Policy:

Cancellations made 48 hours ahead of the start of the event will receive a full refund. Cancellations made between 24 and 48 hours before the event will be subject to a 50% cancellation fee. No refunds will be provided for cancellations made within 24 hours of the event.


Responsibility and Safety:

(a) Legal Drinking Age:

Guests and attendees must be of legal drinking age as per state laws. We reserve the right to request identification.


(b) Responsible Consumption:

Zoom Bar LLC promotes responsible alcohol consumption. We reserve the right to refuse service to intoxicated individuals.


Insurance and Liability:

(a) Insurance:

Zoom Bar LLC carries liability insurance coverage for our bartenders and services.


(b) Indemnification:

By booking with Zoom Bar LLC, you agree to indemnify and hold us harmless from any claims, damages, or liabilities related to our services.


(c) Permitting Responsibility:

The customer is 100% responsible for obtaining proper permitting, licenses, and approvals required for the event, including any TABC license, if applicable. Zoom Bar LLC, Zoom Bar LLC employees, or independent contractors hired by Zoom Bar LLC are not liable if said event does not obtain proper permitting to supply alcohol for the event.


Amendments and Updates:

Zoom Bar LLC may update these Terms from time to time, and the updated version will be effective on the date specified at the top of this document. We will notify customers of significant changes. Disputes and Arbitration:


(a) Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Tennessee.


(b) Dispute Resolution:

Any disputes arising under or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.


Miscellaneous:

(a) Entire Agreement:

These Terms and our operating agreement constitute the entire agreement between Zoom Bar LLC (doing business under the name "Zoom Bar") and you, superseding any prior agreements.


(b) Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Liability Waiver & Indemnification

LIABILITY WAIVER

I have read and understand this waiver and have been fully informed of all Zoom Bar (collectively referred to as “the company”) terms and conditions as well as benefits and limitations. I certify that I have disclosed all medical conditions that might affect my treatments as well as previous products and services used and their side effects, if any. The authorized staff of the company disclaims liability for any loss, injury, claim, or damage related to your use of its products and services, including without limitation, those resulting from errors or omissions, a site or application being down, data loss, and unsatisfactory aesthetic outcomes. The company will not be liable to you for any indirect, incidental, consequential, reliance, or special damages, including without limitation damages arising from any court action or legal dispute. In no event shall the aggregate liability of the company, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability, or other theory, arising out of or relating to the use of the company products or services, exceed any compensation paid by you for treatment by the company during the three months prior to the date of any claim. I release my providers from any injury or complication resulting from undiagnosed medical conditions present during my treatment. I assume all responsibility for updating changes in physical and mental condition.

 

INDEMNIFICATION

I will indemnify and hold harmless all authorized staff of the company and its officers, agents, employees, representatives, and assigns from any costs, damages, expenses, and liability caused by your use of any of the company products and services.
